ARTIST PARTICIPATION AGREEMENT

 

AGREEMENT OVERVIEW

 

This Agreement sets forth the terms and conditions under which the Participant may engage in activities and services offered by Ink & Easel including but not limited to art classes, workshops, events and other programs. This Agreement shall be governed by and construed in accordance with the laws of the State of New York.

 

This Participation Agreement is entered into as of the date provided at the end of this agreement between Ink & Easel (“Studio”), a limited liability company organized under the laws of the State of New York, with its principal address at 2277 Bellmore Avenue, Bellmore, NY 11710, and the individual identified as the participant in the signature section of this Agreement (“Participant”), acting on their own behalf or as a parent/legal guardian of a minor.

 

SECTION 1: PARTICIPATION POLICY

 

1.1 Participant Responsibilities

Participant agrees to comply with all Studio rules which may be provided in writing or verbally by Studio representatives. Misuse of materials, damage to property, or disruptive behavior may result in termination of participation in Studio activities without refund.

1.2 Use of Equipment

Participants are responsible for proper use of Studio provided equipment including but not limited to paint brushes, adhesives, sculptor tools, materials, and paint. Any intentional or grossly negligent damage to Studio property caused by the Participant may result in the Participant assuming the cost of replacement or repair.

1.3 Assumption of Risk

Participants agree to follow all safety instructions, studio policies and directions provided by Studio representatives. Participants acknowledge that participation in Studio activities including but not limited to painting, drawing, crafting, sculpting, the use of tools, materials, chemicals and equipment may involve certain inherent risks. These risks may include, but are not limited to allergic reactions, exposure to fumes, minor cuts, burns, slips, falls or other injuries that may occur during the normal course of participation. Participant voluntarily and knowingly assumes all inherent risks associated with such activities.

 

SECTION 2: PAYMENT TERMS

 

2.1 Payment Required in Advance

All fees for events, workshops or activities must be paid in full prior to the start of the scheduled service. The Studio does not accept partial payments or deposits. Refund and Cancellation Policies are subject to Section 3 of this agreement.

2.2 Accepted Methods of Payment

Payment may be made online through Inc and Easel’s website or in person prior to the start of the scheduled service.

SECTION 3: CANCELLATION POLICY

 

3.1 Cancellation by Participant

Participant may cancel their scheduled activity forty-eight hours prior to the scheduled start date to receive a full refund. After this period, Makeup credits can be issued as defined in Section 3.3

3.2 Cancellation by Studio

Studio may cancel any event, workshop or activity for any reason. Participants may choose either a full refund or the opportunity to reschedule for a future equivalent Service.

3.3 Emergency Cancellation and Makeup Credits  

Participant unable to attend due to illness or emergency within forty-eight hours of scheduled start date, may request a makeup credit that will apply to future workshops. Makeup credits under these circumstances may be issued at the Studios sole discretion.

 

SECTION 4: SERIES WORKSHOPS

 

Participants enrolled in a multi-week workshop series are not entitled to refunds once the series has commenced. Participants may receive one makeup session per series, subject to the Studio’s availability and scheduling. Makeup sessions must be completed during designated makeup times established by the Studio and may not be rescheduled beyond those designated sessions. Makeup sessions have no cash value and may not be transferred, substituted or redeemed for refunds or credits. Payment policies and cancellation policies for multi-week workshops are subject to Sections 3 & 4 of this agreement.

 

SECTION 5: PARENTAL CONSENT (APPLICABLE FOR PARTICIPANTS UNDER AGE 18)

 

The Parent/Legal Guardian, on behalf of the Minor, hereby grants the participation of the Minor in the activities at the Studio. The Parent/Legal Guardian hereby waives, releases, and discharges the Studios from any and all claims, demands, actions, causes of action, or liabilities of any kind, whether known or unknown, arising out of or relating to the Minor's participation.
